)This permission shall enure solely for the benefit of Marita Carter and for no other person, persons or organisation and shall not enure for the benefit of the land. Reason - To retain planning control to ensure that the planting required under the Forestry Commission's Restocking Notice is maintained and replaced as necessary in order to protect the character of the landscape. |

)The development hereby permitted shall be used only as private, non-commercial, equestrian use and for no other purpose. Reason - To prevent the land from being used for commercial purposes to the detriment of the character of the locality and amenities of neighbours. |

)The replanting of vegetation on the land shall be protected from damage and maintained, including replacement of losses, as required by the Forestry Commission under its Restocking Notice Number 8 under the Forestry Act 1967 (Section 17a) Land to the Rear of Greatham Inn, for a period of 10 years from the successful restocking (April 2009). Reason - To protect the character of the landscape. |

)Within three months of the date of this permission details of the measures to dispose of manure and other waste are to be submitted to and agreed in writing by the Planning Authority. The approved details shall be implemented on commencement of use of the land for equestrian purposes and shall be retained thereafter. Reason - To ensure that the amenity of the area is not detrimentally affected by the use of the site. |

)Notwithstanding the provisions of the Town and Country Planning General (Permitted Development) Order 1995, Schedule 2, Part 2 (or any Order revoking or re-enacting that Order), no fences, walls or other means of enclosure shall be erected without the prior written consent of the Planning Authority, through submission of a formal planning application. Reason - In order to maintain control over future use of the land in the interests of the character of the landscape. |

)Any gates provided shall be set back a distance of 6m from the edge of the carriageway of the adjoining highway and shall not open out over the public highway. Reason - In the interests of highway safety. |

)A hard surface consisting of 100mm of MOT Type 1 scalpings shall be laid from the existing hard surface adjacent to the access to a point 8m from the face of the kerb. This shall be a 2.4m in width. The works shall be completed to a standard to be agreed in writing with the local planning authority and no surface water shall be allowed to drain onto the highway. No digging shall take place within the root protection areas of the adjacent trees. Reason - In the interests of highways safety. |

)The surface of the manege is to remain as the original soil/earth surface and no new materials shall be imported to the surface without the prior written agreement of the local planning authority. Reason - To protect the character of the landscape. |

)No parking or storage of trailers or horse boxes, or storage of other equestrian paraphernalia apart from horse jumps shall be permitted on the site without the prior written consent of the Local Planning Authority. Reason - To protect the character of the landscape. |

)No external lighting or floodlighting shall be permitted on the site. Reason - To protect the character of the landscape. |

)No buildings or other structures shall be sited on the land. Reason - In the interests of the protection of the landscape character. |

)Details of the location of the storage area for any horse jumps shall be agreed in writing with the local planning authority within three months of the date of this permission, and shall be provided prior to the commencement of the approved use and thereafter retained and used to store this equipment when not in use. Reason - To protect the character of the landscape. |

)The Council has granted permission because:
The application has been assessed in terms of whether the works and change of use can be retained in the long term without causing harm in planning terms, including in terms of the landscape in the proposed National Park. It is concluded that the impact will be acceptable.
It is therefore considered that subject to compliance with the attached conditions and taking into account all other material planning considerations, including the provisions of the development plan, the proposal would be acceptable. This also includes a consideration of whether the decision to grant permission is compatible with the Human Rights Act 1998. |

)The applicant is advised that there is a fee for the discharge of conditions relating to this application. A single fee will apply to each batch of conditions submitted for discharge at the same time. The information to discharge a condition will not be accepted by the Council without the appropriate fee.
